1. We have confirmed that the Bergamot Community HOA has not contracted with a towing company contrary to requirements per Section 4.28 of the CC&Rs... excuse provided by HOA's legal counsel: time, cost, effort required. Do not have info as to who dropped the ball - i.e., Board or Keystone.
2. Per IDR on 8/11/25, Keystone is in process of obtaining towing contract and vehicle-code conforming signage to address motor court parking issues; unable to obtain an ETA.
3. HOA Board is still controlled by Meritage and consists of the following employees -
- Efrem Joelson, President - Director of Forward Planning, Meritage Homes Linked In Bio
- Emma Hill, VP
- Nick Harris, Secretary - Manager of Forward Planning, Meritage Homes Linked In Bio
4. The level of negligence may be more pervasive than initially thought:
Facebook Group posts allude to a scheduled March 20th conference call that may not have been initiated by the Host (HOA Board?). Nick Harris of the HOA Board (per IDR on 8/11/25) claims call took place despite K. Weldon's comment per above.
5. IDR on 8/11/25; A more detailed SUMMARY FORTHCOMING. For now:
HOA Board took zero responsibility for its failure to enforce motor court parking rules with vehicle-code conforming signage and, instead, attacked me: accused me of policing the neighborhood and complaining too much; informed me that HOA has received many complaints re our bodycam (I explained that I would continue to wear this regardless of how others felt about it).
Interestingly, we were not able to obtain details re the alleged harassment complaints made against us (we don't believe these exist and will continue to push for these).
6. Requesting ADR.
How do you live in your new home when you are prohibited from reporting legitimate concerns to management?
How do you live in your new neighborhood when you do not feel safe walking around without a bodycam?
7. Reluctantly listed our house for sale (8/10/25): LP $30K below purchase price in Feb 2025; expect further loss of 5% in selling commissions plus legal expenses (IDR, ADR, + potential litigation).
