5. HOA's Cease & Desist Letter and Our Response
HOA's Attempt to Intimidate
Furthermore, contrary to the accusations per the Cease & Desist letter, I maintain that I have not harassed nor threatened anyone at Keystone (as my emails to the property management prove) and will continue to vigorously rebut the false narrative. UPDATE 08/11/25: Per IDR, we learned that Keystone's accusations of harassment relate to the "tone" and quantity of my emails (thus, a bogus accusation). I requested specific examples, but the HOA's attorney refused to provide these (probably because this is a bogus accusation!). Interestingly, the HOA's attorney informed us that it would not address the accusations made by Meritage Sales as the HOA only deals with HOA matters. R i i i i g h t!
I recognize that complaints and criticism of the HOA's failure to enforce the governing documents may be inconvenient for Meritage who is still trying to sell units to the public, but this this does not excuse the way in which it has treated me. I need to be clear in that my sole purpose in communicating with the HOA and Keystone is to report issues that are clearly contraindicated per the community's CC&Rs and affect our household and/ or detract from the aesthetics and appeal of the community and, ultimately, our property values. As an interior design aficionado, I am fully invested in the appearance of my community. Having said that, if I, personally, did not have to do the reporting, I'd be in a much better place, as I would most certainly prefer to be rearranging my furniture than preparing spreadsheets, pivot tables, and Violation Reports for the management company on any given day! Unfortunately, judging from the aluminum foil that's been covering the window of one of the homes facing the street for 8 months, it looks like I'm on my own.
Aluminum foil on window reported to Keystone on 4/11/25 has yet to be removed as of 12/02/25. UPDATE: With the assistance of our attorneys, on 12/18/25, we succeeded in getting residents to remove the foil from the window... it took less than 24hrs to accomplish, so we're struggling to understand why Keystone was unable to do this in 8 months.

Going back to the discussion regarding my accusers, aside from Keystone staff, the HOA's legal counsel also mentioned a real estate agent in its Cease & Desist letter, so, sometime in June 2025, we approached the only real estate agent we'd had conversations with about the issue of parking in the motor court. This individual happens to be the owner of the property across the motor court which is a rental. Per the video that follows, he denied making any accusations against us:

So, we have rebutted the HOA's accusations of harassment and/ or threatening behavior against Keystone staff and realtors and, hopefully, demonstrated that these are bogus. The last of my alleged accusers is discussed in the previous post.
I'd like to end this post by sharing that my husband and I have endured this type of bullying before and recognize that we're being attacked for pointing out the Meritage-led HOA Board's incompetence and negligence in enforcing the community's CC&Rs. Meritage is attempting to deflect from the discussion of its incompetence and negligence by making this about me... but, I'm only relevant in terms of how Meritage's incompetence and negligence have affected me... and my husband and I intend to continue to vigorously defend ourselves against Meritage's bogus accusations.
