HOA's Invalid Fine Schedule Invalidates Fines

We have attempted to engage the HOA's President in a discussion regarding the community's violation fine schedule since August 2025, but continue to be ignored and have yet to receive a reply as of May 2026.  Specifically, we have attempted to address that it appears that the HOA's current fine schedule is invalid as it does not conform to the new California law (AB 130) that went into effect on June 30, 2025 and caps fines at $100 (unless they relate to health or safety issues).    

The issue resurfaced recently since fines amounting to a few hundred dollars were posted to our account.  We reached out to our attorneys for guidance and learned that, given the invalid fine schedule, the HOA cannot lawfully impose monetary penalties on homeowners.  We were informed that we cannot, unfortunately, reverse the violation fines made to other members of the association (otherwise, we would!) as each household is required to dispute their own.  We demanded that the fines posted to our account be immediately reversed by the HOA - if you were fined, you should, too!

Our Violations Log lists unpermitted motor court parking incidents in the Willow community from mid-March 2025 to the Present Day.  To reiterate, we started documenting unpermitted motor court parking after repeated incidents of blocked ingress/ egress to/ from our garage and, incredibly, being accused of business interference and harassment and threatened with arrest by Meritage for telling potential buyers, vendors, and/ or other visitors they were NOT allowed to park in the motor court (and most certainly NOT in front of our garage).     UPDATE (03/19/26) :    ADR unsuccessful; we are moving forward with our lawsuit against the HOA. TOP 09 MOTOR COURT PARKING VIOLATORS (Willow)

Our reports to Management   regarding unpermitted motor court parking activity in the Willow community have been ignored by the HOA since April 2025 when we started submitting these after having our garage repeatedly blocked by vehicles belonging to prospective tenants, prospective buyers, new homeowners, and Meritage employees and vendors.  As such, this year, in an attempt to both educate our neighbors and obtain a reprieve, we proceeded to enforce the CC&Rs against the Top 9 violators with the assistance of our attorneys.  We started by issuing Cease & Desist letters, but a few homeowners refused to comply and actually defied the Cease & Desist, so we were forced to escalate with demands for Alternative Dispute Resolution (ADR) which is required by the governing documents for member-to-member disputes.  It is astonishing to have discovered that anyone would forgo an opportunity to mediate, thereby willingly exposing themselves to a lawsuit.  Alas,...
